STL Designer Terms and Conditions

These STL Designer Terms and Conditions (“Terms”) govern your access to and use of the KaleidaCuts STL Designer, including its design tools, conversion services, generated STL files, account pages, and related features (collectively, the “STL Designer”).

The STL Designer is operated by KaleidaCuts INC, doing business as KaleidaCuts (“KaleidaCuts,” “we,” “us,” or “our”).

By accessing the STL Designer, submitting a design for processing, purchasing or using credits, or downloading a generated STL file, you agree to these Terms. If you do not agree, do not submit a design or use the STL Designer.

1. Description of the STL Designer

The STL Designer allows users to upload or create two-dimensional artwork, preview a cutter design, and submit the design for conversion into a downloadable STL file.

The STL Designer uses automated processes to analyze submitted designs and generate STL files. Not every image or design can be successfully converted.

2. Accounts and Eligibility

You must provide accurate account and contact information when using the STL Designer.

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian. You are responsible for maintaining the confidentiality of your account and for activity conducted through your account.

3. Artwork Uploaded During Design

Artwork uploaded or displayed while creating and previewing a design is not retained by KaleidaCuts merely because it was loaded into the designer.

When you submit a design for conversion, the design information necessary to process the request is transmitted to and may be stored on our servers. This allows us to:

  • Process the submitted design;
  • Generate the requested STL file;
  • Make the resulting STL file available through your account;
  • Troubleshoot processing problems; and
  • Provide customer support.

Your submitted designs and generated STL files are not published or made available to other STL Designer users.

4. Ownership of Your Artwork

You retain all ownership rights that you hold in the artwork, images, designs, text, logos, or other materials that you submit to the STL Designer.

KaleidaCuts does not claim ownership of your original artwork or of the decorative shape or design you create using the STL Designer.

You represent and warrant that:

  • You own the submitted material or have permission to use it;
  • You have the right to have the material converted into an STL file;
  • Your submission does not infringe another person’s copyright, trademark, patent, privacy, publicity, or other legal rights; and
  • Your use of the STL Designer complies with applicable law.

The STL Designer does not give you ownership of artwork, characters, logos, trademarks, or other material owned by someone else merely because the software is capable of processing it.

5. Limited Permission to Process Your Design

By submitting a design, you grant KaleidaCuts a limited, nonexclusive, royalty-free permission to host, copy, process, modify as technically necessary, and convert the submitted material solely for the purpose of:

  • Operating the STL Designer;
  • Generating and delivering your STL file;
  • Maintaining access through your account; and
  • Providing technical or customer support.

This permission does not allow KaleidaCuts to sell, publish, publicly display, or commercially use your artwork for an unrelated purpose.

6. KaleidaCuts Technology and Cutter Construction

KaleidaCuts retains all rights in the STL Designer software, website, source code, conversion processes, algorithms, interface, documentation, branding, and standard cutter-construction methods.

Generated cutters currently use KaleidaCuts’ standard design specifications, including our established cutting edge, wall construction, thickness, and related structural features. These specifications are not currently adjustable unless an adjustment option is specifically displayed within the STL Designer.

We may update or modify our standard cutter construction as the STL Designer develops. As a result, STL files generated at different times may not be identical in construction.

7. Rights to Generated STL Files

Once an STL file has been successfully generated and delivered to you, you may use, download, copy, modify, share, distribute, sell, sublicense, or otherwise use the generated STL file for personal or commercial purposes.

You may also manufacture, use, give away, or sell physical products created from the generated STL file.

These rights apply only to the generated STL file and do not:

  • Give you ownership of artwork, logos, characters, trademarks, or other material owned by another person;
  • Give you permission to use third-party material beyond the rights you already possess;
  • Transfer ownership of the STL Designer software, source code, conversion technology, interface, branding, or other KaleidaCuts intellectual property; or
  • Permit you to falsely represent that the STL Designer software or KaleidaCuts technology was created or is owned by you.

You remain responsible for ensuring that your use, sale, or distribution of the generated STL file and any resulting physical products complies with applicable laws and does not infringe the rights of another person.

8. Conversion and File Availability

A generated STL file will become available for download after the conversion process has been successfully completed.

Processing time may vary depending on the design, system demand, technical conditions, and other factors. We do not guarantee that every design will be processed immediately or within a specific amount of time.

Some designs may be unsuitable for conversion because of their complexity, image quality, line structure, proportions, unsupported details, or other technical limitations.

If we are unable to successfully convert a submitted design into a usable STL file, the credits used for that conversion will be restored or the applicable payment will be refunded, as appropriate.

A design will not qualify for a refund merely because the resulting file requires normal slicer settings, printer calibration, orientation, supports, or other adjustments associated with 3D printing.

9. File Retention and Customer Backups

Submitted design files and generated STL files may be retained so that we can make them available through your My STLs page and provide customer support.

However, KaleidaCuts does not guarantee that submitted designs or generated STL files will be retained for any minimum amount of time.

Files may be deleted, removed, corrupted, or become unavailable at any time. You are responsible for downloading completed STL files promptly and maintaining your own backup copies.

The STL Designer and the My STLs page are not intended to serve as permanent file-storage or backup services.

10. Removing Your Files

You may request removal of your submitted design files and generated STL files by selecting the Remove My Files option on the My STLs page or by emailing support@kaleidacuts.com.

Removing your design files may permanently prevent you from downloading them again. Deleted files may not be recoverable.

Removing design files does not automatically delete your KaleidaCuts account, order history, credit transactions, customer-service communications, or other business records maintained under our Privacy Policy.

11. Credits, Prices, and Payments

The number of credits required for a conversion will be displayed before the design is submitted.

Prices, credit packages, conversion costs, and available features may change. Changes will apply prospectively and will not reduce credits already available in your account unless otherwise disclosed or required to address fraud, misuse, or an account error.

Credits:

  • May only be used with eligible KaleidaCuts services;
  • Cannot be transferred between accounts without our permission;
  • Have no cash value except where a refund is required by these Terms or applicable law; and
  • May not be sold or exchanged outside the STL Designer.

Except for failed conversions, billing errors, or circumstances in which a refund is required by law, completed and successfully delivered STL conversions are nonrefundable.

12. 3D Printing and Physical Use

The STL Designer generates a digital file. KaleidaCuts does not control the printer, slicer, filament, resin, print settings, calibration, manufacturing environment, or post-processing methods used to create the physical item.

You are responsible for:

  • Inspecting the STL file before printing;
  • Selecting appropriate slicer and printer settings;
  • Confirming the dimensions and strength of the printed item;
  • Using materials suitable for your intended purpose;
  • Determining whether a material or manufacturing process is appropriate for food contact;
  • Cleaning and maintaining printed items properly; and
  • Using cutters and cutting edges safely.

Variations in printers, materials, slicers, extrusion, shrinkage, calibration, and user settings may affect the dimensions, durability, sharpness, appearance, and performance of the finished item.

You assume responsibility for the manufacture and use of any physical item produced from a generated STL file.

13. Prohibited Uses

You may not use the STL Designer to:

  • Violate any law or regulation;
  • Infringe another person’s intellectual-property or personal rights;
  • Upload malicious code or interfere with the operation or security of the service;
  • Attempt to access another user’s account or files;
  • Circumvent credit, payment, access, or usage restrictions;
  • Reverse engineer, copy, scrape, or exploit the STL Designer except as permitted by law;
  • Use automated systems to place excessive demands on the service; or
  • Create or distribute material that is unlawful, fraudulent, threatening, or intended to cause harm.

We may reject or remove a submission that we reasonably believe violates these Terms.

14. Availability and Changes to the Service

We may modify, suspend, limit, replace, or discontinue any part of the STL Designer at any time.

We do not guarantee that the STL Designer will always be available, uninterrupted, secure, or free from errors. Maintenance, technical problems, software updates, third-party service failures, or other circumstances may temporarily prevent access to the service or previously generated files.

15. Suspension or Termination

We may suspend or terminate access to the STL Designer when we reasonably believe that a user has:

  • Violated these Terms;
  • Submitted unlawful or infringing material;
  • Attempted to misuse or interfere with the service;
  • Engaged in fraudulent payment or credit activity; or
  • Created a security or legal risk for KaleidaCuts or another person.

Termination may result in the loss of access to submitted designs and generated STL files. You should maintain your own copies of all files you wish to keep.

16. Privacy and Security

Our collection and use of account information and other personal information are described in our Privacy Policy.

Although we use reasonable measures intended to protect the STL Designer and customer information, no online system or method of electronic storage can be guaranteed to be completely secure.

Do not submit confidential, sensitive, or personally identifying information as part of an artwork or design unless it is necessary and you are comfortable doing so.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the STL Designer and all generated files are provided on an “as is” and “as available” basis.

KaleidaCuts does not warrant that:

  • Every submitted design can be converted;
  • Every generated STL file will meet every user’s specific needs;
  • A file will be compatible with every slicer, printer, material, or manufacturing process;
  • Printed dimensions will be exact on every printer;
  • Files will remain available for any specific period; or
  • The service will be uninterrupted or error-free.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, KaleidaCuts will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the STL Designer, generated files, lost designs, lost profits, production delays, failed prints, material costs, or the manufacture or use of a physical item.

To the fullest extent permitted by law, KaleidaCuts’ total liability arising from a particular STL conversion will not exceed the amount you paid for that conversion or the value of the credits used for it.

These limitations do not apply to liability that cannot legally be limited or excluded.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold KaleidaCuts harmless from third-party claims, damages, losses, and reasonable expenses arising from:

  • Artwork or material you submit;
  • Your infringement of another person’s rights;
  • Your violation of these Terms;
  • Your use, sale, sharing, or distribution of a generated STL file; or
  • Your manufacture, sale, or use of a physical item produced from a generated file.

20. Changes to These Terms

We may update these Terms as the STL Designer, our policies, or applicable requirements change.

The updated Terms will be posted with a revised effective date. When required or appropriate, we may also provide notice through the website, your account, or email.

Your continued use of the STL Designer after updated Terms take effect constitutes acceptance of the updated Terms.

21. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law principles.

Any legal proceeding arising from these Terms or the STL Designer must be brought in a court of competent jurisdiction located in Kentucky, unless applicable law requires otherwise.

22. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms, together with our Privacy Policy and any additional license or checkout terms presented to you, constitute the agreement between you and KaleidaCuts concerning the STL Designer.
